The recruiter, potential employer or any other user of the employee database and related products (herein called "The Customer") named on the purchase agreement agrees to use the employee database and related products provided by Career Market Pty Ltd ABN 88 119 861 595 (herein known as "The Publisher") under the following terms and conditions:

1. The Customer agrees and acknowledges that these Terms and Conditions are governed by, and construed in accordance with the law in force in New South Wales. The parties submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in NSW.
2. Terms of trade vary depending on the size of purchase. If agreed upon payment terms are not met, the Publisher can suspend customer services at its discretion.
3. All amounts not paid within the agreed upon terms shall bear interest at the rate of 2% above the Reserve Bank’s 90 day Bill Rate until full payment is received plus all costs, charges and expenses incurred by the Publisher in the attempted collection of any outstanding amounts.
4. Contract Customers agreements expire after 12 months or upon the full utilization of services purchased.
5. Contract Customers subscribe to the database for a 12-month period enjoying a discounted rate based on their committed expenditure over a 12-month period. Any services purchased for that 12-month period must be used during that contract period. Unused services will not be carried forward upon the expiry of the agreement.
6. Requests for cancellation or refunds will not be accepted.
7. The Publisher agrees to provide reliable access to information through the www.careermarket.com.au website. Training tools are available to ensure that maximum benefit is derived by the Customer from use of the Publisher’s database and related products.
8. Warranty & Indemnity
   1. The Publisher makes every effort to ensure that information published is accurate. The Publisher cannot guarantee the accuracy or validity of any candidate information listed on the employee database or related products.
   2. The Customer agrees to indemnify the Publisher, its employees, associates and agents against any and all liability claims or proceedings whatsoever arising from any of the Publisher’s products.
9. The agreement approver / signatory confirms that they are authorized to make this purchase and accept the terms & conditions on behalf of the Customer.
10. The Publisher may disclose certain items of information on this order to a credit reporting agency. The Customer authorizes the Publisher to make enquiries and/or exchange information concerning the Customer’s credit worthiness from any person or source.
11. This contract sets out the terms of the agreement between the parties. Any promise, condition, representation or warranty which may have been made by the Publisher or any person on behalf of the Publisher and which is not set out in this contract is negative and withdrawn. The Customer acknowledges that there is no other agreement or collateral warranties subsisting at the time of this agreement. These conditions shall prevail over any terms or conditions expressed on any other form or document used by the Customer.
